The case between Western Areas NL chairman Terry Streeter and a group of businessmen behind unrelated company Western Areas Exploration will head to trial in March next year.
At a hearing in WA today, Supreme Court Justice Rene Le Miere has listed the matter for trial starting on March 23 next year for 14 days, and a further four days starting from April 14.
Western Areas Exploration is seeking a portion of the profits made by Mr Streeter and director David Cooper after both were allegedly presented with a potential nickel opportunity by three geologists.
Its claimed that Mr Streeter and Mr Cooper, who were both on WAE's board at the time, pursued the nickel prospect to float Western Areas NL.
A spokesperson for Mr Streeter said it was an important milestone to have a date locked in for trial.
"After the plaintiff taking more than six and a half years to commence this action, we look forward to a trial next year to end this matter. In addition, we welcome the Court's ruling of an extended mediation period".
The court previously made orders that the parties submit to mediation in January 2009, but that has now been extended to include Febuary.
Justice Le Miere is still to rule on Streeter and Cooper's application that the plaintiff provide security for costs of the trial.
