Police considers Airpower charges

The prosecution will spend the next six weeks considering if a legal action against prominent businessman Nev Power’s company Airpower Australia is in the public interest.

Airpower Australia pleaded not guilty at Perth Magistrates Court in March to allegations it failed to comply with COVID-19 travel restrictions.

A trial allocation date was scheduled at Perth Magistrates Court this afternoon but the police prosecutor said there was a public interest consideration whether to proceed.

“I don’t know how Airpower is laid out structurally, if the two accused (people) are already convicted,” he said.

The matter is expected return to court on July 19.

Mr Power and his 36-year-old son Nicholas Arthur Power were sentenced in Perth Magistrates Court earlier this year after both pleaded guilty to two counts of failing to comply with a direction under WA's Emergency Management Act.

Nev Power's private company Airpower Australia was also charged with failing to comply with a direction.

The Powers were each dealt an eight-month term of imprisonment suspended wholly for eight months in March.

The charges relate to a trip the father-son duo took to their family cattle station in Queensland in October.

The pair allegedly failed to complete G2G passes before flying from Queensland to Exmouth, Carnarvon, Geraldton, and Jandakot onboard a private helicopter.

The men returned to WA via Exmouth's Mantarays Ningaloo Beach Resort without completing a G2G pass or quarantine for 14 days, with CCTV footage capturing the men moving freely around the resort without a mask.
