Tim Retallack
Tim Retallack has more than 20 years of experience, acting in a wide range of commercial business disputes including obtaining injunctions to restrain a mortgagee’s power of sale, recovering damages for breach of copyright, recovering damages for negligent construction in commercial premises, and obtaining injunctions (search and seizure orders) to recover stolen business records and confidential data. From 2001-2006, Mr Retallack was a partner of a litigation consultancy practice which included long-term project work in relation to two multi-million dollar mine construction and development contract disputes. For 6 years prior to joining Culshaw Miller Lawyers, Mr Retallack worked as a consultant and later as principal Maxim Litigation Consultants, where he conducted a wide variety of commercial litigation matters, primarily in the Superior Courts and Private Arbitrations. From 2008 to 2010, he was instructing solicitor to Chris Zelestis QC and appeared as junior counsel in the High Court in December 2011, successfully opposing an application for special leave in the Western Areas vs Streeter case, a $60million case involving issues of director’s fiduciary duties and diversion of corporate opportunities in relation to a proposed nickel exploration project.
