David John is a partner of Herbert Smith Freehill's commercial litigation team in Perth, with a specialty in insolvency and reconstruction. He has extensive experience acting for clients in complex commercial litigation, and specialises in insolvency law including issues arising under the PPSA. Mr John regularly advises banks, insolvency practitioners and secured lenders on their rights and obligations. He also acts for organisations across a variety of industries including financial services, mining and resources. His commercial litigation experience extends to contractual disputes; actions under the Trade Practices Act 1974 (Cth) for negligent misstatements; breaches of directors’ duties; issues arising from breaches of the Corporations Act 2001 (Cth) security and financing law; and restitution.
