Writ withdrawn

A WRIT relating to telecommunications contracting work under St Georges Terrace against Swiftel Limited has been withdrawn.

Swiftel directors announced to the Australian Stock Exchange that the action against them by Underground Services Australia in the Perth District Court had been discontinued.

“As disclosed in our announcement on June 13, the directors stated the action brought against the company was completely unfounded and without substance or merit,” the statement said.

The USA writ claimed money was owing from work dating back to August 30 and also cited Wingside Nominees, which trades as KLM Group.

According to the writ, a part written, part oral agreement was made between USA and KLM Group “or alternatively between USA and KLM Group on behalf of Swiftel” in August.

The writ claimed the implied terms of the agreement meant USA was to be paid by KLM or Swiftel “the amount of any invoice issued by USA under the agreement” by a date specified or a reasonable time.

It is understood USA was seeking $230,000.
