Industrial waste removal company WA Bins has successfully obtained an order from the Supreme Court of Western Australia to prevent a competitor using the mark "A WA Bins".
The dispute first arose when the competitor placed a large advertisement in the 2004 Yellow Pages using the name "A WA Bins".
The first letter "A" appears in very small font and is positioned over the second letter "A".
The Supreme Court order prevents the competitor from using the name and phrase "A WA Bins" or any deceptively similar version of the name.
The order also required the competitor to transfer the telephone number appearing in the Yellow Pages advertisement to WA Bins.
The matter has now been set down for an assessment of damages.
