Sirtex seeking over $5m from UWA, Gray

Sirtex Medical says it is continuing to pursue the recovery of its legal costs and expenses of over $5.5 million as proceedings against the University of Western Australia and Bruce Gray approaches its third year.

In its quarterly today, the Sydney-based company said while UWA and Dr Gray are likely to dispute various aspects of the costs, it expects to recover a "significant proportion" of the amount.

"However, at this time, it is not possible to provide a useful or precise estimate of the amount to be recovered," Sirtex said.

The complex legal proceedings centre on a liver cancer treatment technology which is currently being commercialised by Sirtex. UWA is claiming a beneficial interest, saying Dr Gray developed the technology while he was employed at the university.

Sirtex has also filed a claim against Dr Gray, claiming that if the intellectual property is held liable to UWA, then it is entitled to indemnity.
