Paspaley Pearling Company has been charged over the death of 22-year-old pearl diver Jarrod Hampton, who died while working off the Kimberley coast in 2012.
Paspaley has been charged by WorkSafe for failing to provide and maintain a safe working environment for its employees.
On April 14 2012, Mr Hampton died on his second day working for the family-owned company.
Paspaley faces a maximum penalty of $200,000.
“The investigation was a significant and complex one,” Mr McCullough said.
“The matter is now in the hands of the courts, and WorkSafe will not make any further comment.”
