Last month the Court of Appeal dismissed the appeal brought by Yarri Mining to take control of the project.
On July 21 EMA described the action by Yarri Mining as opportunistic and a significant impediment to the company's growth and investor appeal.
Very little is known about Yarri Mining but in a statement today EMA said the company had lodged an application to the High Court for special leave to appeal.
"EMA has no reason to consider that the outcome of this latest foray will be any different to its predecessors."
"The application is likely to be determined late this year or early next year," the company said in a statement.
