Construction company John Holland and two contractors are facing federal work health and safety charges over an incident that injured a worker at Main Roads WA’s $1 billion NorthLink road project.

Construction company John Holland and two contractors are facing federal work health and safety charges over an incident that injured a worker at Main Roads WA’s $1 billion NorthLink road project.

The Commonwealth Director of Public Prosecutions has filed a total of four charges in the Magistrates Court of Western Australia against John Holland, the now-liquidated Omega Construction, and Universal Reo.

There is one charge each against John Holland and Omega Construction and two against Universal Reo, alleging the companies failed in their duties under the Commonwealth Work Health and Safety Act 2011.

All charges are category two offences under the WHS Act, each carrying a maximum penalty of $1.5 million.

The charges come one week after the Court of Appeal in WA upheld penalties against Best Bar Reinforcements and a Harvey Norman franchisee. Best Bar was required to pay $1.38 million in compensation to a worker after he sustained a back injury at one of its facilities.

John Holland was the principal contractor for the southern section of NorthLink and subcontracted Omega Construction for the project.

The injured worker was employed by Universal Reo, a subcontractor to Omega.

The incident occurred in February 2017 when workers were moving a load of steel posts with a telescopic handler at a section of the project on Tonkin Highway in Morley.

A worker was walking beside a vehicle and attempting to stabilise the load when the telescopic handler struck him in the leg, causing severe fractures.

He was treated at Joondalup Hospital.

The matter will be heard in the Magistrates Court on March 15.

Bibra Lake-based Omega was liquidated in October last year, after cost blowouts related to the NorthLink project.

Omega was working as a subcontractor for BGC Contracting and Laing O'Rourke on a different section of the project.

NorthLink is a transport link between Morley and Muchea.

In May last year John Holland was fined $281,250 after the Commonwealth Director of Public Prosecutions filed charges over an incident in which a worker narrowly escaped being crushed at an Adelaide construction site.
