South Perth residents sue Golder Associates

The owners of 100 Mill Point Road have mounted another lawsuit over a flood in the building’s car park in 2017, this time pursuing four companies for alleged ‘negligence and nuisance’.

According to a writ lodged in the Supreme Court last week, the owners of strata plan 11020 are seeking damages and costs from four parties: Wembley engineering firm CMW Geosciences, multinational engineer Golder Associates and Colmic Holdings, which trades under Hutchinson Associates.

The fourth named defendant, Vortex Group of Companies, is currently owned by National Pump and Energy.

The allegations centre around a water ingress in the basement of 100 Mill Point Road in South Perth that caused weeks of flooding.

Western Power was forced to intervene at one stage during the flood, deeming it an electrical hazard and demanding the evacuation of residents across the first three floors.

In the writ, the owners of 100 Mill Point Road claim the defendants' negligence and nuisance caused the water ingress to the basement car park of the property.

The court action comes nearly 12 months after the same group of owners sued Hanssen claiming it was the company's negligence that led to the ingress. 

The flooding coincided with the construction of Finbar Group’s Aurelia project, a high-rise apartment development being built just 50 metres away on Harper Terrace.

At the time, it was reported Hanssen had been pumping water from the Aurelia site to holding ponds at a site adjacent to 100 Mill Point Road - now home to Finbar’s $404 million twin tower Civic Heart apartment development.

Golder Associates was acquired by Canada-based environmental consultant WSP in April 2021.
