The Regal Theatre's operators have applied to grill the man at the helm of Fiore Group as part of its pursuit of $850,000 lost in an alleged investment scam, as new information casts doubt over a rundown of his assets.

Interstar’s lawyers have been fighting to track down the cash for almost a year, which they claim was lost after the theatre manager inked a deal with Osborne Park-based broker Halston Capital and its managing director Scott Mundell to double its money in 30 days.

It is alleged private company Fiore Group, a family trust led by corporate analyst Jonathan Fiore and previously spearheaded by his father Peter, is tied to the scam.

Interstar’s lawyers successfully gained freezing orders against the parties in the hope of clawing back some of the funds.

Although the focus initially appeared to be on Peter, lawyers have since turned their attention to his son Jonathan and the affairs of the family trust.

Jonathan filed an asset disclosure affidavit on behalf of the trust company.

But it is understood Interstar’s lawyers have since come into possession of information which indicates there may be discrepancies in the group’s disclosure.

Now, Hotchkin Hanly lawyer Nick Kalmund is seeking a formal examination of Jonathan, a move which brought the matter back before Supreme Court Justice Gail Archer this morning.

The two parties have been told to provide their availability by 4pm today, with submissions to be filed in the coming weeks ahead of a possible examination later this year.
