Win over silos for Kierath

THE Supreme Court has denied three of the four points raised in action by the City of Fremantle over Heritage Minster Graham Kierath’s ruling on the former CBH silos.

In making its decision, the court found Mr Kierath had been entitled to take into account economic considerations and the degree of cultural significance and had not acted unreasonably.

“Today is a triumph for common sense and in time I believe my

decision will be fully vindicated,” Mr Kierath said.

“Even at this early stage of proceedings, the court has seen fit to deny three of the four points raised by the council.”

The City of Fremantle is challenging a decision by Mr Kierath not to grant heritage protection to the silos.

The council had not taken any legal action to halt demolition

currently underway.

“I made a decision to protect the heritage of the working port which is the backbone to Fremantle rather than some obsolete silos,” Mr Kierath said.
