New breastfeeding legislation begins

THE Federal Sex Discrimination Amendment (Pregnancy and Work) Act, which prevents discrimination on the grounds of pregnancy, potential pregnancy and breastfeeding has now commenced.

The amendments, which commenced on November 12, make it unlawful to ask women for information about pregnancy or potential pregnancy where discrimination on those grounds would be unlawful.

Medical information about a woman’s pregnancy or potential pregnancy may only be requested for legitimate reasons, such as for occupational health and safety issues.

The amendments serve as a reminder to employers to pay careful attention to questions they ask during employment interviews.

The proper conduct of an interview with a prospective employee is the doorway to a successful employer/employee relationship thereafter.
