Environment prosecution policy under review

The State Government is reviewing its rigorous environmental enforcement policy to assist the fight to stamp out pollution.

Environment minister Mark McGowan said the Enforcement and Prosecution Policy was first released in November 2004 as part of a package of legislation reform to tighten up environmental enforcement in Western Australia.

"We made a commitment to review the policy after the first 12 months, and we are now seeking public comment to ensure it remains relevant, effective and up-to-date," he said.

"We would like to encourage stakeholders including industry and the community to provide their views on the policy by March 3, 2006 so their comments can be analysed and applied for possible improvements."

Mr McGowan said the Enforcement and Prosecution Policy covered all legislation administered by the Department of Environment and the Swan River Trust.

"We are specifically seeking feedback on whether the policy meets expectations in outlining the decision-making process and enforcement options available, and whether there are other issues relevant to enforcement that should be included or covered in more detail," he said.

"We are also after input on any sections of the policy that stakeholders do not consider as current, relevant or effective.

"The objective of the policy is to guide officers in achieving compliance with the legislation being enforced, and not to substitute for professional judgement and common sense."
