Bullying and discrimination in the workplace are issues which have taken on greater significance in recent years and especially so with the introduction of the adverse action provisions in the Fair Work Act and the recently introduced anti-bullying provisions in the same Act.

The impact on a workplace where there is discrimination or bullying can be significant not only in terms of loss of productivity and staff but it can also result in the imposition of significant fines for breaches of the Fair Work Act and injunctions in the case of bullying and/or claims for compensation. It is essential to understand what amounts to discrimination and bullying in the work place and how to successfully deal with it.
