The Commonwealth Government has passed legislation in the form of the Clean Energy Bill 2011 which provides for a price to be placed on carbon emissions. Arguably the Act will make significant changes to both property law and the practice of valuation when a carbon emission is encountered. The Act introduces offsets to the pricing of carbon which must now be accounted for in assessing the viability of property developments, and also when property is offered as a security for a mortgage.
